Prenuptial Agreements

Rancho Cucamonga Prenuptial Agreement Lawyer

Nothing can kill romance faster than the word prenup, but with about one in three of all first marriages ending in divorce, and 50 percent of second or third ones hitting the skids, a prenup is smart financial planning.

A prenuptial agreement, antenuptial agreement, or premarital agreement, commonly abbreviated to prenup or prenupt, is a contract between spouses prior to marriage that establishes financial and property rights in the unfortunate event of a divorce. The content of a prenuptial agreement can vary widely, but commonly includes provisions for division of property and spousal support in the event of divorce or breakup of a partnership or marriage. They may also include terms for the forfeiture of assets as a result of divorce on the grounds of adultery; further conditions of guardianship may be included as well. In order for a prenupt agreement to be valid, there are strict technical requirements that need to be adheared to. James J. Kenny, has developed unique approaches in our prenuptual agreements process that will make it more likely that the agreement will stand the test of time. One of the worst things that could happen to someone would be to have a prenup prepared that doesn't comply with the technical requirements. If those technical requirements have not be met, and the couple gets married thinking they have protection only to find out then when they get divorced they have an unenforceable agreement.
